A recent High Court case really underlines how important it is to think carefully about who you appoint as your executors.
In the estate of Dorothy Jahme, worth around £400,000, a family dispute spiralled so badly that the Court had to step in. Two sisters, both named as executors of their late mother’s will, ended up in a bitter conflict. Allegations of hostility, lack of cooperation, and even questionable financial transactions led the judge to remove them and appoint a professional executor instead.
The Court made it clear: executors must be able to act fairly, conscientiously, and without personal conflict. When family relationships are strained, the emotional weight of grief can make that almost impossible.
It’s a reminder that even with the best of intentions, not everyone is suited to be an executor. Although I am not always keen on using professional executor, bringing in a neutral professional can protect both the estate and the family’s relationships.
When planning your will, it’s worth asking yourself, not just who do I trust, but who can truly stay objective when it matters most?
